Zazna.com Privacy Policy

General Terms

The owner of the zazna.com website (hereafter referred to as "the Website" or "the System") is Hypercontext Sp. z o. o., seated in Tczew, Wojska Polskiego 11, Polska, entered into the reg­ister of entrepreneurs of the National Court Registry under no. 0000313405 by the District Court Gdańsk-Północ in Gdańsk, VII Economic Department, with the share capital of PLN 50,000 (fifty thousand Zlotys) (hereafter referred to as "the Owner" or "the Administrator").

The Website User (hereafter referred to as the "User") is a person who properly performed the User Registration procedure as referred to in the Terms of Service.

1.This Privacy Policy defines the rules governing the collecting, processing, provision and use of all types of information which can be used to identify an individual, as well as information which can indirectly, by combination with other information, enable or lead to the identifica­tion of a specific individual (both types of information are hereafter referred to as "Personal Data"). Matters not covered by this Privacy Policy, significant in the context of the protection of personal data, are dealt with in this Website’s Terms of Service document, which is appli­cable to all the Website Users, and can be accessed at www.zazna.com.

The Administrator is a company originated and registered in Poland, and, to the extent de­scribed in the Privacy Policy and the Terms of Service, it is bound by the provisions of Polish law, especially by the Polish Personal Data Protection Act of August 29, 1997, and by the ap­plicable provisions of international law. Hypercontext Sp. z o.o., based in Tczew, serving in the capacity of the administrator of the personal data collected by means of the Website, is bound by law to guard the safety of data submitted by the Users. The Administrator guaran­tees the protection of the rights of all the Users, as defined by the August 29 1997 Personal Data Protection Act, and in particular the right to access to one's personal data, the right to demand revision of the data to fit current status and to demand the removal of personal data, as well as the right to protest, in cases defined in the Act.

The Website is operated using computers located in Poland and the USA. By providing Per­sonal Data to the Website, the User states they are aware and acknowledge that the data will be sent to the USA or Poland.

Any questions or doubts concerning the Administrator’s Privacy Policy should be submitted to the Administrator at the e-mail address of support@zazna.com.

This Privacy Policy is effective from November 1, 2008. The Administrator can amend the Web­site’s Privacy Policy. Such amendments are in effect the moment the revised version of the Privacy Policy is published on the Website. By continuing to use the Website after any such amendments have been put in place, the User agrees to and acknowledges all such amendments.

Collecting Personal Data

The Website collects the following types of Personal Data:

(Registration Data) In order to complete the User registration procedure, the Administrator col­lects personal data in the form of an e-mail address. The User Name (login, nick) selected as part of the registration procedure can contain the User’s personal data if the User chooses to include it in the user name, but such inclusion of personal data in the User Name is voluntary. In order to complete the registration procedure and to begin using the Website, the User must provide their User Name and password. The User should be advised that other Website Users will always be able to access and see the User Name selected in the registration procedure.

(Voluntary Data) Other types of data can be provided during the registration procedure or while using the System. The provision of such data by the User is not mandatory and is vol­untary at all times. The data in question includes: name, surname, title, pseudonym / nick­name, telephone, fax and pager number, e-mail addresses, address of residence, name of em­ployer, and website addresses. The provision of some of the types of data described above can however be necessary in order to use certain Website services, and in such cases, the User will be notified of such need before they use the particular service. These types of data, once sub­mitted, will remain accessible and visible to other Website Users. By selecting the appropriate options in their Profile Settings, the Users can change their Profile Data, as well as determine the extent and the manner in which the said types of data can be accessed by other Website Users.

(Other data) The Administrator also collects other types of data, necessary to manage the Web­site, gather and evaluate statistical information, and for security reasons, which particu­larly includes IP addresses, general data concerning Website Users and other individuals ac­cessing the Website, and the type of web browser in use.

(Cookies) Cookies are small text messages, generated by the web server and saved on the User’s computer. Cookie file parameters allow only the server which originally created them to read the data they contain. The Administrator uses cookie files in order to collect statistical data, for websites which require logging in, for certain advertising procedures, and to monitor User activity and the activity of other individuals accessing the Website. Cookies are also sent by parties responsible for the creation of the advertising material that the Website contains. The User can configure their computer to determine the manner in which cookie files are stored in their system, which includes the option to completely disallow accepting cookie files. Should all cookie files be blocked in this way, certain Website services may become inacces­sible to the User.

(Log Data) When the Website is being accessed, the Administrator's servers register data sent by the User's web browser. The server log can store such information as web requests, IP ad­dresses, web browser type and language, the date and time the request was sent, and cookie files.

(User Communication) The Administrator stores all correspondence sent to it by the User.

Personal Data Handling Policy

All Personal Data is collected, stored and processed only to enable the User to access certain Website services, including services displaying non-standard information and advertising in the System, as well as handling audit, research, and analysis procedures necessary for the con­stant provision and improvement of the Website’s services and technology. The Administrator may make personal data accessible to other parties in certain cases, such as when obliged to take certain action by decree of the applicable state or legal institution, in order to prevent fraud or irreparable damage, or in order to protect Website security.

The Administrator may only transfer the possession of any User’s Personal Data, or make it ac­cessible to third parties in any way, in the following situations:

  • if the person identified by the personal data has provided explicit consent;
  • if the personal data is being made accessible to subsidiaries or other parties in order for the personal data to be processed on the Administrator’s behalf, solely for the pur­poses of providing the services available in the System. In this case, the recipient must consent to process any such data on terms determined by the present Privacy Policy, and to employ other means of ensuring the confidentiality and security of the personal data.
  • if access to the personal data is made mandatory by law, or by a request enforced by the power of the state or a legal institution;
  • if the provision of personal data is necessary to enable the detection, prevention or re­pair of technological malfunctions within the System, related to System security or unauthorized third party System use;
  • in case of a company asset transfer which should include the Website, or in case of a merger of the Administrator with another company.

The User is advised that by storing Personal Data of other individuals in the System, the User ac­knowledges that they will be held solely responsible for any damage resulting from storing such Data. The Administrator exercises the same standards of Personal Data protection, as de­fined in the present Privacy Policy, regarding both the User’s Personal Data and the Personal Data of other parties, stored by the User in the System. The Administrator cannot however be held responsible for the consequences of the User’s actions. Therefore it is suggested that the User obtain consent to store Personal Data in the System from every party identified by the Personal Data prior to storing such Data in the System.

The Security of Personal Data

The Administrator will exercise the appropriate security measures in order to protect Personal Data from unauthorized access, alteration, public disclosure, or destruction.

These measures are both technological solutions implemented in the Website itself (such as the use of the appropriate encryption technology for data transmitted over the Internet, and the strict control of physical access to the computer systems and data storage media containing the Personal Data) and the implementation and application of the appropriate Personal Data han­dling procedures and protocols.

All the security measures implemented by the Administrator in order to ensure Personal Data Protection are in compliance with the appropriate provisions of Polish law, in particular the articles of the Polish Personal Data Protection Act of August 29, 1997, and the applicable pro­visions of international law.

Accessing, Altering and Removing Personal Data

The Administrator provides every registered User with a Profile Page. This Page allows the User to access, modify, and remove all of the User’s Personal Data in the Administrator's pos­session.

The Administrator enables the User to terminate their account. Account termination results in rendering all the Personal Data submitted by the User inaccessible within the System. It is im­portant to note that User Account termination does not entail the physical deletion of such Per­sonal Data.
